- Characteristics and purpose of a cookie
Preliminarily, the user must know that a cookie is a small file that sites store on visitors’ computers and it can collect various information during navigation. More specifically, it’s the web browser that stores cookies on the device used (for example a computer or mobile phone).
When the user returns to a site he has already visited, the site is able to read this information stored in the cookie and provide, for example, a personalized browsing experience. - Types of cookies, specific purposes based on the type and legal basis of the processing.
Cookies can be divided into different categories:
- First or third party (in relation to the subjective profile of the publishers).
Cookies are “first-party”, if they are managed directly by the owner of the site visited, or “third-party”, if are set up or managed by an organization other than the one that owns the site visited (perhaps because the site contains elements that reside on servers different from those that host the site visited).
- Session or permanent (in relation to the cookie storage time profile).
Cookies are divided into “temporary” or “session”, which expire at the end of a browser session (i.e. when the browser is closed), and “permanent”, which remain memorized even after the browser is closed (think of sites that allow you to store your login credentials).
- Technical, profiling or analytics (in relation to the function and purpose of the processing).
There are “technical” cookies, which are used by the data controller to provide a service requested by the user or to allow navigation and without which some operations could not be performed or would be more complex and/or less secure (such as, for example, cookies that allow you to remain authenticated during online banking operations). For these reasons, it should be considered that, to use these cookies, it is sufficient for data controller to provide the relative information, being exempt from the obligation to request consent for installation. Therefore, the legal basis will mainly be represented by the execution of a contract (art. 6, 1, b, Regulation) or by the fulfillment of a legal obligation (art. 6, 1, c, Regulation).
Besides, there are “profiling” cookies which let to trace the user’s navigation on the net and create profiles on his tastes, habits, choices. In this way, the data controller can modulate the provision of the service so that it is exactly in line with the user’s interests (for example, to provide advertising messages that conform to his tastes). The cookies used for these purposes may be installed on devices only after obtaining the user’s consent, so that the legal basis of the processing will be consent (art. 6, 1, a, Regulation).
Lastly, “analytics” cookies are positioned between these last two categories. Analytics cookies are used to evaluate the effectiveness of a service provided by the data controller, or for the design of the web platform, as well as to better measure its traffic, i.e. the number of visitors broken down by geographical area, connection time slot or other characteristics. These are profiling cookies if they allow the user to be directly identified, therefore, for their installation, the user must express consent. Conversely, they are similar to technical cookies, when they are created and used directly by the site to improve usability or when, although provided by third parties, they adopt tools that reduce or cancel the identifying power of the natural person (for example by masking part of the IP address). Therefore, it will be necessary to foresee the possibility that the same cookie can be referred not only to one, but to more devices, in order to create a reasonable uncertainty about the user’s identity. Only in this last case, the analytics cookies will not require consent.

- Data retention
The personal data collected will be kept for the retention times indicated, for each cookie, in the appropriate consent customization tool that appears, below, when the Site is opened, or, subsequently, by pressing the appropriate button always available on the Site. However, some data could be kept for a longer period of time in the event of hypothetical computer crimes against the Site, for the management of any disputes, to fulfill to legal obligations, to carry out internal and external investigations or inspections.
